By subscribing to our hosting service, you agree to these terms and conditions. These terms can be modified at any time by Penney Layne and by continuing the use of our services you agree to be bound to any modifications. By using our services you agree to these terms and conditions regardless whether or not you have read them.
All websites hosted by Penney Layne must have the credit link INTACT for the duration of hosting the site with us. Failure to display the required credit link violates our terms of service and will subject your account to suspension and/or termination as well as copyright infringement laws. Penney Layne also requires the display of our banner link on your links page. The credit link includes the graphic(s) credit if applicable, as well as the "powered by" for the host provider.
Penney Layne offers free technical support via our support ticket system throughout all clients' hosting period. Please utilize the support ticket system for support rather than direct email.
Penney Layne provides various site builders and shop carts to every customer with no warranty or condition. We strive for 100% uptime, however technical problems can occur that are beyond our control and you can rest assured we will address them as expeditiously as possible. Penney Layne cannot be held responsible for site downtime or any loss associated with any downtime such as profit loss, sales loss, or any other damages or loss arising out of the services we offer. Currently we operate at 99.99% uptime.
Site installs performed by Penney Layne are initial installs only. After site delivery, it is the hosting client's responsibility to perform regular site backups and maintain the backups in a secure location, preferably off site. Penney Layne is not responsible or liable in ANY way for host clients' failure to perform and maintain regular site backups. Penney Layne is not responsible or liable in any way for the integrity of a backup and cannot guarantee full restore capability for any backup due to many varying factors. It is suggested to keep more than one backup and date each one, preferably one current and three prior. It is suggested to store backups off site such as on a backup server or other reliable method, but never keep all backup files on one machine in case of machine failure.
Site installs are basic site installations, not custom programmed sites unless otherwise specified. If webset installation is included in a hosting plan or purchased under special services, we install the basic graphics from a client selected webset including webtopper, backgrounds, logo. On DIY sites only, category buttons are also installed. If client is seeking a complete custom programmed site with specific design requests and site needs, that service is considered a custom website and is offered under special services.
After initial site install and site turnover, Penney Layne will make light modifications for a period of thirty (30) days within reason. This does not include changing out originally selected graphics or webset, or extensive site overhaul, but moderate and necessary tweaking of the site as the client becomes more familiar with its layout and use. Extensive changes can be obtained through our special services section and/or through our retainer option.
Penney Layne delivers sites in operating condition. Penney Layne is in no way responsible for site down issues that are caused by changes made to the site by hosting client. If a client is unsure of a change, client should contact Penney Layne prior to making the change(s). There is no fee for general site support so please utilize the service when necessary. It is suggested that each client make a backup of any files they intend to alter prior to the change(s), so that in the event of an issue, client can restore the original operable file.
Penney Layne is in no way responsible for site security issues that may occur on your site. Penney Layne will provide suggestions of ways to prevent site security issues and strongly recommends you follow them and be sure to make regular site backups and maintain them in a secure and safe location. We recommend remote file storage locations which are available at many locations.
All accounts will be billed automatically and clients are responsible for immediate payment. Unpaid accounts are subject to suspension after due date has passed. Failure to make prompt payment within 5 days of suspension date will result in site termination and will be subject to a $50.00 reconnection fee and the payment of all prior and current amounts due. For payment plan accounts, payment plan will no longer be available and full payment of all amounts due will be required for reconnection in addition to the $50.00 reconnection fee. Penney Layne accepts family oriented sites only and we reserve the right to cancel services for failure to comply with our terms of service, and we reserve the right to refuse service to anyone without notice or liability for such termination. All cancellations must be submitted prior to your next billing date.
No refunds will be made or offered for early cancellation of any hosting account. Monies paid place the account under contract for the specified period.
Penney Layne serves as a hosting provider only. Penney Layne shall not be held responsible or liable and is held harmless in the event of any sales, legal, chargeback, security, etc. issues that arise between our clients and their customers. SSL certificates are available for an added fee. We advise utilizing reputable and reliable payment methods, such as MAL's, paypal, authorize.net, or other reputable and secure payment options to your customers.
Copyright infringement is against the law. Websites hosted by us can be suspended and/or terminated in the event of copyright infringement. Copyright infringement is not limited to graphics, but also content, products, images, photographs, unauthorized copying of books, music, or any other copyrighted material, etc. Please use original content and/or content you have permission to use. Please place required and proper credit links in the site footer. Copyright infringement of ANY kind is strictly prohibited. No refunds will be issued for accounts suspended and/or terminated for copyright infringement or failure to abide by the law.
Trademark infringement is also strictly prohibited. Offering counterfeit merchandise that infringes upon a trademark will result in termination of the hosting account. No refunds will be issued for accounts suspended and/or terminated for trademark infringement or failure to abide by the law.
